Terms of Service

Please read these Terms of Service carefully before using Neighbrr. By creating an account, checking the agreement box at signup, using the Neighbrr platform, or accessing any part of the Neighbrr Platform (as defined below), you agree to be bound by these terms. If you do not agree, do not use Neighbrr.

These Terms constitute a legally binding agreement between you and Neighbrr LLC, a New Jersey limited liability company. "Neighbrr," "we," "us," and "our" refer to Neighbrr LLC. "You" refers to any person who accesses or uses our platform.

1. What Neighbrr Is

Neighbrr is a hyperlocal neighborhood platform that allows homeowners to drop verified pins on a neighborhood map for contractors they have hired, and allows contractors to claim profiles and connect with homeowners in their area. Neighbrr is a platform — we do not employ contractors, perform home improvement services, or guarantee the quality of any contractor's work.

The Neighbrr Platform refers collectively to all Neighbrr digital properties, websites, web applications, mobile experiences, and related pages, including but not limited to Neighbrr.co (our landing page and informational website) and Neighbrr.app (our web application and user platform), as well as any subdomains, future domains, or digital properties operated by Neighbrr LLC. These Terms apply to your use of any and all parts of the Neighbrr Platform, regardless of which URL you visit or how you access it.

Neighbrr is not a contractor referral service. We are a platform that enables neighbors to share verified job information with one another. Any relationship formed between a homeowner and a contractor through Neighbrr is solely between those two parties.

2. Who Can Use Neighbrr

To use Neighbrr you must:

By creating an account you represent and warrant that all of the above are true. Neighbrr reserves the right to suspend or terminate any account that does not meet these requirements.

3. Account Registration and Verification

To use Neighbrr you must create an account by providing a valid phone number, email address, and home or business address. You agree to provide accurate, current, and complete information and to keep it updated.

Phone verification: Neighbrr uses SMS verification codes to confirm your phone number at registration. You must have access to the phone number you register with.

Address verification: Homeowners must provide a valid residential address. Neighbrr uses Google Maps address autocomplete to confirm that addresses are real. Providing a false address is a violation of these Terms and will result in account termination.

You are responsible for maintaining the security of your account credentials. Neighbrr is not liable for any loss or damage resulting from unauthorized access to your account.

4. SMS Communications

This section is required by US carriers and Twilio. Please read it carefully. By providing your phone number and creating an account on Neighbrr, you expressly consent to receive SMS text messages from Neighbrr LLC.

By creating a Neighbrr account and providing your phone number, you expressly consent to receive SMS text messages from Neighbrr LLC at the phone number you provide. These messages may include:

Message frequency: Message frequency varies based on platform activity in your area. You may receive multiple messages per day during active periods.

Message and data rates may apply. Standard message and data rates from your mobile carrier may apply to SMS messages you receive from Neighbrr.

How to opt out: You may opt out of SMS communications at any time by replying STOP to any message you receive from Neighbrr. After opting out, you will receive one final confirmation message. Note that opting out of SMS may affect your ability to use certain platform features that require SMS verification.

Neighbrr uses Twilio to deliver SMS messages. By using our platform you also agree to Twilio's messaging policies. Neighbrr is not responsible for delays or failures in SMS delivery caused by your mobile carrier or Twilio.

5. Homeowner Terms

As a homeowner using Neighbrr you agree to:

Neighbrr's platform is free for homeowners. Neighbrr reserves the right to introduce paid features for homeowners in the future with reasonable advance notice.

6. Contractor Terms

As a contractor using Neighbrr you agree to:

Free trial: Contractor accounts include a free trial period — 90 days for Founding Contractors and 30 days for Pro Monthly and Pro Annual plans. No payment is charged until the free trial ends. You may cancel at any time before the trial ends without being charged.

Subscription and billing: After the free trial, contractor accounts are billed on a monthly or annual basis depending on the plan selected. Subscriptions automatically renew unless cancelled before the renewal date. Neighbrr processes payments through Stripe. All fees are in US dollars and are non-refundable except as required by law.

Founding Contractor rate: Contractors who sign up during the pilot launch period at the Founding Contractor rate of $69/month will have that rate locked for the life of their active subscription. The rate lock applies only to continuous active subscriptions — if a Founding Contractor cancels and resubscribes, the founding rate is not guaranteed to be available.

Profile status after cancellation: If a contractor cancels their subscription or their subscription lapses due to non-payment, their contractor profile becomes inactive but remains visible on the Neighbrr platform. Pins dropped by homeowners referencing that contractor remain on the neighborhood map, as those pins belong to the homeowners who submitted them and are not the property of the contractor. An inactive contractor loses the ability to claim, manage, update, or respond to their profile until they resubscribe. Neighbrr reserves the right to display inactive profiles with a status indicator reflecting that the contractor does not currently hold an active subscription.

7. Location Access

The Neighbrr platform requests access to your device's location when you open the neighborhood map. Here is exactly what that means in plain language:

8. Prohibited Conduct

You agree not to use Neighbrr to:

Neighbrr reserves the right to investigate violations and take appropriate action including suspending or terminating accounts, reporting activity to law enforcement, and pursuing legal remedies.

9. Privacy and Data

Your use of Neighbrr is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Neighbrr you consent to the collection and use of your information as described in our Privacy Policy.

What we collect: Name, email address, phone number, home or business address, and information about contractor jobs you pin or confirm.

What we share: Homeowner names and addresses are shared with contractors for job verification purposes only. Your public privacy settings control what information appears on the public neighborhood map. Regardless of your privacy settings, the information you provide to verify a job will always be shared with the contractor involved in that verification.

10. Intellectual Property

All content, features, and functionality of the Neighbrr platform — including but not limited to the Neighbrr name, logo, software, map interface, and design — are owned by Neighbrr LLC and protected by US and international copyright, trademark, and other intellectual property laws.

The Neighbrr name and logo are the subject of pending trademark registration in the United States in International Classes 009 and 042. Unauthorized use of the Neighbrr name or logo is prohibited.

By posting content on Neighbrr — including reviews, pin information, and profile details — you grant Neighbrr LLC a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating and improving the platform.

11. Disclaimers and Limitation of Liability

Neighbrr is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.

We do not verify contractor quality. Neighbrr verifies that a job occurred and that both parties confirm it — we do not inspect work, verify contractor insurance, guarantee workmanship, or resolve disputes between homeowners and contractors.

Neighbrr does not verify contractor licenses, insurance, bonding, certifications, or professional qualifications of any kind. Contractor profile information — including any license numbers displayed — is self-reported by the contractor. Neighbrr makes no representation that any contractor is licensed, insured, bonded, or qualified to perform any work. Homeowners are solely responsible for independently verifying a contractor's credentials, licenses, and insurance directly with the contractor and applicable licensing authorities before hiring. Neighbrr is not liable for any damages, losses, injuries, or costs arising from a homeowner's failure to independently verify a contractor's qualifications.

We are not responsible for contractor actions. Any contractor you find through Neighbrr is an independent third party. Neighbrr is not liable for the quality, safety, or legality of any contractor's work.

To the maximum extent permitted by law, Neighbrr LLC's total liability to you for any claims arising from your use of the platform shall not exceed the amount you paid to Neighbrr in the three months preceding the claim, or $100, whichever is greater.

In no event shall Neighbrr LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of the platform.

12. Force Majeure

Neighbrr shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond Neighbrr's reasonable control. This includes but is not limited to: acts of God, natural disasters, pandemic, fire, flood, war, terrorism, civil unrest, government action, internet or telecommunications outages, third-party platform failures (including Bubble.io, Twilio, Stripe, or any other service provider), power failures, or any other event outside Neighbrr's direct control.

In plain English: if Neighbrr goes down because Bubble.io has a server outage, Twilio stops delivering messages, there's a widespread internet failure, or any other event we have no control over — Neighbrr is not responsible for that disruption and you are not entitled to a refund or compensation for the period of unavailability caused by that event.

13. Indemnification

You agree to indemnify, defend, and hold harmless Neighbrr LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses — including reasonable attorneys' fees — arising from your use of the platform, your violation of these Terms, or your violation of any third party's rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Neighbrr shall be resolved in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.

Before initiating any legal proceeding, you agree to contact Neighbrr at hello@neighbrr.app and give us 30 days to attempt to resolve the dispute informally.

15. Changes to These Terms

Neighbrr reserves the right to update these Terms at any time. When we make material changes, we will notify you by email or by a prominent notice in the platform. Your continued use of Neighbrr after changes become effective constitutes your acceptance of the updated Terms.

We will always post the most current version of these Terms at neighbrr.app/terms and neighbrr.co/terms with the date last updated.

16. Termination

You may close your Neighbrr account at any time by contacting hello@neighbrr.app. Neighbrr reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, non-payment, or for any other reason at our discretion.

Upon termination, your right to use the platform ends immediately. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, indemnification, and governing law — will survive.
